Disgraced former Weinstein Company chief Harvey Weinstein has been sued for spying on actress Paz de la Huerta, one of Weinstein’s many accusers who said he raped her twice in 2010. De la Huerta’s former attorney sued Weinstein on Friday for allegedly using an attorney to spy on her to gain information such as psychiatric records. (Weinstein has “unequivocally denied” any allegations of nonconsensual sex.)
The suit, Variety reports, accuses attorney Michael F. Rubin of spying on de la Huerta last fall and attempting to discourage her from reporting the alleged rape. Rubin, Weinstein, and The Weinstein Company are included in the suit, which was filed by de la Huerta’s former attorney Aaron Filler (she’s now represented by Carrie Goldberg). Filler also claims that Weinstein and Rubin collaborated to get de la Huerta to drop Filler as her attorney.
In an interview, Rubin said that, “Every allegation in that lawsuit is false” and denied ever meeting or being employed by Weinstein.
“I don’t know Harvey Weinstein. I never met Harvey Weinstein,” Rubin said. “I had nothing but Paz de la Huerta’s interests in mind. This guy is upset he lost a potential client.”
Filler said that he’d brought up the suit to call attention to the fact that the investigation by Manhattan district attorney Cyrus Vance into de la Huerta’s rape case has stalled. “Our purpose is to investigate what caused the N.Y. D.A. criminal investigation and criminal prosecution to stall, and to call TWC/HW to account if they used extra-legal means as we believe they did,” Filler told Variety in an email. De la Huerta’s case is of special interest in the ongoing investigation into the accusations against Weinstein because her claims fall within New York’s statute of limitations, while many actress‘s stories of assault and harassment happened decades ago. Filler’s firm Tensor Law will reportedly donate any monetary damages form the case to Time’s Up, an organization backed by 300 prominent industry in figures created to combat sexual harassment in Hollywood.
